Terms of Service

These Terms of Service (the “Terms”) govern your use of Hablalo, an AI-assisted language-learning application available at hablalo.io and its associated apps (together, the “Service”). The Service is operated by Wiktor Piotr Pawlikowski, a self-employed individual (autónomo) based in Spain — Calle Martínez Maldonado 11, 3A, 29007 Málaga, Spain (“we”, “us”, or “the operator”). You can reach us at hello@hablalo.io.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Please also read our Privacy Policy and Refund Policy, which form part of these Terms.
1. The Service
Hablalo helps you learn a language through spaced-repetition reviews, a dictionary, word lists, a reading library, and AI-assisted practice such as writing feedback, generated stories, and conversational exercises. Some features rely on third-party AI providers to process the text you submit and generate responses. The Service is provided for personal, non-commercial learning use.
We offer a free tier and two paid plans, Ink and Folio. The free tier includes core study tools and limited daily allowances. The paid plans raise those allowances and other limits. The current feature split and limits are described on our pricing page and may change as the Service evolves.
2. Your Account
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your password and account secure, and for activity that occurs under your account. Tell us promptly at hello@hablalo.io if you suspect unauthorised use.
- One account per person. Accounts are personal to you and may not be shared, sold, or transferred.
- You must be at least 16 years old to use the Service. If you are not, please do not create an account.
3. Acceptable Use
You agree not to:
- use the Service for anything unlawful, abusive, or harmful, or to infringe anyone’s rights;
- scrape, crawl, or harvest content or data from the Service, or attempt to circumvent rate limits or usage allowances;
- reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Service, except to the extent this restriction is prohibited by applicable law;
- resell, sublicense, or commercially exploit the Service or its AI outputs without our written permission;
- interfere with the Service’s operation, security, or other users, including by submitting malware or automating access in a way that places an unreasonable load on our systems.
Fair use of AI features. AI features are subject to a daily allowance, stated on the pricing page and in the app. This protects the Service for everyone and keeps costs sustainable. Usage that materially exceeds the published allowance, or that appears automated or abusive, may be throttled, rate-limited, or temporarily restricted. We will act reasonably and, where a restriction is more than momentary, aim to let you know.
4. Paid Subscriptions
Billing through Polar
Payments for paid plans are processed by Polar (Polar Software, Inc. and its affiliates), who act as the merchant of record and authorised reseller for the Service. This means Polar is the seller for your purchase and handles payment, billing, the calculation and remittance of applicable VAT or sales tax, and invoices. Your purchase is also subject to Polar’s buyer terms. We never receive or store your full card details.
Auto-renewal, price, and period
Paid plans are offered on a monthly or annual basis. The price and billing period are shown clearly at checkout before you pay. Unless you cancel, your subscription renews automatically at the end of each billing period at the then-current price for that plan, and the payment method on file is charged. If a renewal price will differ from your current price, you will be told before it takes effect.
Free trial
Where a 7-day free trial is offered, you may use the plan’s paid features during the trial at no charge. Unless you cancel before the trial ends, your paid subscription begins automatically and your payment method is charged at the end of the trial at the price shown at sign-up. You can cancel during the trial at any time to avoid being charged. One trial per person.
Cancellation
You can cancel a paid plan at any time from the billing portal linked in your account settings, or by contacting us. Cancellation takes effect at the end of the current billing period — you keep your plan’s access until then, and you will not be charged again. We do not provide partial-period refunds for cancellation, except where the Refund Policy or your statutory rights say otherwise.
5. Your EU Consumer Rights
If you are a consumer in the European Union, you have important statutory rights that these Terms do not take away.
Right of withdrawal (14 days)
You normally have 14 days to withdraw from a purchase of digital content or services without giving a reason. Because a paid plan is a digital service you can use immediately, you are asked at checkout to expressly consent to performance beginning during the withdrawal period and to acknowledge that you lose the right of withdrawal once performance has fully begun. If you have given this consent and started using the paid service, the statutory 14-day withdrawal right no longer applies. Independently of this, our Refund Policy offers a money-back option that is at least as generous.
Conformity of digital content
Your statutory rights regarding the conformity of digital content and digital services — under EU Directive 2019/770 as implemented in the law of your country of habitual residence (in Spain, the General Law for the Defence of Consumers and Users) — remain fully unaffected by anything in these Terms. If the Service is not as described or does not work as it should, you may be entitled to have it brought into conformity, to a price reduction, or to terminate, as provided by law. Nothing here limits these rights.
6. Changes & Availability
We are continually improving the Service, so features may be added, changed, or removed over time. We provide the Service on a reasonable- efforts basis and do not promise any particular uptime or service level (no SLA). We may suspend the Service for maintenance or for reasons outside our reasonable control. For changes that materially and adversely affect a paid feature you rely on, we will give reasonable advance notice where practicable.
7. Content & Intellectual Property
Your content stays yours. The text you write, submit, or generate using your account (for example, writing you ask the Service to review) remains yours. You grant us a limited, worldwide, royalty-free licence to host, process, and transmit that content solely to operate and provide the Service to you — including sending it to our AI providers to produce the features you request. We do not use your content to train our own models. See the Privacy Policy for how your data is handled.
Our content stays ours. The Service itself — including its software, design, branding, curated lessons, and other materials we provide — is owned by the operator or our licensors and is protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable right to use the Service for your own learning while these Terms are in force. AI-generated output produced for you is provided for your personal learning use.
8. Disclaimers
Hablalo is a learning aid. AI-generated explanations, translations, and corrections can occasionally be inaccurate or incomplete, and should not be relied on as professional, legal, medical, or other expert advice. To the extent permitted by law, the Service is provided “as is” without warranties we have not expressly given. This does not exclude or limit the statutory guarantees you have as a consumer.
9. Liability
To the extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits or excludes liability where the law does not allow it. This includes liability for death or personal injury caused by negligence, for intent or gross negligence, for fraud, and any liability that cannot be limited under applicable mandatory law — in particular your mandatory rights as a consumer, which remain unaffected.
10. Suspension & Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully or in a way that harms the Service or other users; where the circumstances allow, we will give notice and an opportunity to put things right. If we terminate your paid subscription other than for your breach, we will refund any prepaid, unused period.
11. Governing Law & Disputes
These Terms are governed by the law of Spain. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside — you keep the benefit of those rules.
We would rather solve any problem directly, so please contact us first at hello@hablalo.io — most issues are resolved quickly. If we cannot resolve it together:
- Consumers in Spain may use the consumer arbitration system (Sistema Arbitral de Consumo) or seek free help from a municipal consumer information office (OMIC).
- Consumers elsewhere in the EU may contact their national consumer-protection authority or an accredited alternative dispute-resolution (ADR) body in their country.
12. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the “last updated” date above and, where the change materially affects you, take reasonable steps to notify you (for example, by email or an in-app notice). Continuing to use the Service after a change takes effect means you accept the updated Terms; if you do not agree, you may stop using the Service and cancel.
