Términos del servicio

Este texto está redactado en inglés y no tiene versión en español.

These terms govern your use of Háblalo, the language-learning service at hablalo.io, its apps and its browser extension. The service is run by Wiktor Piotr Pawlikowski, a self-employed individual (autónomo) in Spain: Calle Martínez Maldonado 11, 3A, 29007 Málaga, Spain, tax number (NIF) Z3966763G, wiktor@hablalo.io, telephone +34 685 231 729. “We” and “us” below mean him.

You accept these terms, together with the Privacy Policy and the Refund Policy, when you create an account.

1. The service

Háblalo helps you learn a language with lessons, spaced reviews, a dictionary, word lists, reading and AI features such as the assistant, writing feedback, roleplay and voice conversation. AI features are answered by the outside providers named in the Privacy Policy. The service is for your own, non-commercial learning.

The free plan includes the study tools and a daily allowance of AI requests. The paid plans, Ink and Folio, raise the allowances and limits. The pricing page lists what each plan includes.

2. Your account

  • You must be at least 18. You confirm this when you sign up.
  • Give accurate details and keep your password to yourself. Tell us at wiktor@hablalo.io if you think someone else is using your account.
  • One account per person; accounts are not transferable.

3. Using the service

You agree not to:

  • use it for anything unlawful or to infringe anyone’s rights;
  • scrape it, get round rate limits or allowances, or automate access in a way that loads our systems;
  • reverse-engineer it, except where the law allows you to;
  • resell the service or its AI output without our written permission.

AI features have a daily allowance, shown on the pricing page and in the app. Use far beyond it, or that looks automated or abusive, may be slowed or paused, and we tell you when a restriction lasts.

Reports

An AI reply you find offensive, harmful or wrong can be reported from the reply itself, and a mistake in a dictionary entry from the entry. For anything else you believe is unlawful, write to wiktor@hablalo.io saying where it is and why. We review each report.

4. Paid plans

The seller

Paid plans are sold by Polar Software, Inc., which acts as merchant of record: Polar takes the payment, charges the VAT or sales tax for your country, issues the invoice and pays any refund. Polar’s buyer terms cover the purchase itself; these terms cover the service you get.

Renewal and price

A plan renews automatically at the end of each month or year at the price shown when you bought it, and the payment method on file is charged, until you cancel. We tell you about a price change at least 30 days before it applies; if you don’t accept it, cancel before then.

Free trial

Where a 7-day free trial is offered, nothing is charged during it. If you don’t cancel before it ends, the plan starts and the price shown at sign-up is charged. One trial per person.

Cancelling

Cancel online at any time on the Subscription page in your account (it opens Polar’s billing portal), or write to us. The plan stays active until the end of the period you paid for and is not charged again.

5. Your rights as a consumer

Withdrawing within 14 days

You can withdraw from a plan within 14 days of buying it, without giving a reason. After a free trial the 14 days run from the first charge. Any clear statement sent before the 14 days end counts: an e-mail to wiktor@hablalo.io, a letter, or the form below, which you may use but don’t have to. You can also withdraw online on the Subscription page, under “Withdraw from contract here”; the page shows the date and time we received your statement. The plan starts as soon as you buy it. If you withdraw, Polar pays back everything you paid for the plan, to your original payment method, within 14 days of your notice, and the plan ends.

A renewal on the same terms is not a new purchase and starts no new withdrawal period; the Refund Policy covers renewals. A change of plan, or the first renewal at a new price, has its own 14 days.

Model withdrawal form (complete and return this form only if you wish to withdraw from the contract):

  • To Wiktor Piotr Pawlikowski, Calle Martínez Maldonado 11, 3A, 29007 Málaga, Spain, wiktor@hablalo.io:
  • I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods (*)/for the provision of the following service (*),
  • Ordered on (*)/received on (*),
  • Name of consumer(s),
  • Address of consumer(s),
  • Signature of consumer(s) (only if this form is notified on paper),
  • Date

(*) Delete as appropriate.

When the service is not as described

Your legal rights when a digital service does not conform to the contract (Directive (EU) 2019/770, in Spain the Ley General para la Defensa de los Consumidores y Usuarios) stay in full: we bring it into conformity, or you are entitled to a price reduction or to end the contract.

6. Changes and availability

We keep improving Háblalo, so features change over time. We aim to keep it running but do not promise any level of uptime, and we may pause it for maintenance. We give notice before a change that removes or materially worsens a paid feature, and you may then cancel.

7. Content

What you write and upload stays yours. You let us store, process and show it only to run the service for you, including sending it to the AI providers for the features you use. We do not use your content to train AI models.

The software, design, lessons and dictionary belong to us or our licensors. You may use them for your own learning while these terms apply. AI output produced for you is for your own learning too.

8. AI output

Háblalo’s lessons, stories and dictionary entries are written by AI, and so are the explanations, translations and corrections you get. Any of them can be wrong or incomplete. Check anything that matters, and don’t rely on them as professional, legal or medical advice. This does not limit your legal rights as a consumer.

9. Liability

We are liable under the law that protects you as a consumer, and nothing in these terms excludes or limits that liability, in particular for death or personal injury, for intent or gross negligence, or for a service that does not conform to the contract.

10. Ending the contract

You can delete your account at any time in Settings. Deleting it ends a plan that still renews at once, so nothing more is charged. We may suspend or close an account that seriously or repeatedly breaks these terms or the law, after warning you where the circumstances allow. If we close it for any other reason, you get back the unused part of a paid period.

11. Complaints

Send a complaint or a question about the service by e-mail to wiktor@hablalo.io (the channel you used to sign up), by telephone on +34 685 231 729, or by post to Wiktor Piotr Pawlikowski, Calle Martínez Maldonado 11, 3A, 29007 Málaga, Spain. We answer within 14 days.

12. Law and disputes

Spanish law governs these terms. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. If a complaint is not resolved, consumers in Spain can turn to the Sistema Arbitral de Consumo or a municipal consumer office (OMIC), and consumers elsewhere in the EU to their national consumer authority or an approved dispute-resolution body there.

13. Changes to these terms

We tell you about a change to these terms by e-mail or in the app at least 30 days before it applies. If you don’t accept it, you can cancel and delete your account before then, and you get back the unused part of a paid period.
